1. Eligibility
You must be at least 18 years old and legally able to enter a binding agreement. You must provide accurate contact, identity, address, and payment-preference information requested for the transaction.
2. Ownership and Authority
You represent that you own the submitted hardware or are authorized by its owner to sell it, and that it is free of liens, leases, theft claims, activation locks, management locks, and other restrictions that would prevent transfer.
3. Quotes and Offer Validity
Instant quotes are estimates based on the exact hardware, manufacturer, condition, quantity, accessories, packaging, and other information you provide. Pricing may change until a trade-in is submitted.
Standard quotes and custom, manual-review, negotiated, and adjusted offers generally remain available for seven calendar days from issuance unless the offer states a different deadline. Once you accept and timely submit an offer, normal market fluctuation alone will not reduce it; the hardware remains subject to inspection and these terms.
4. Inspection and Accurate Descriptions
BuyMyTEK may verify model, specifications, quantity, condition, functionality, included components, authenticity, account or firmware locks, contamination, and damage. You must accurately describe and, when practical, test the hardware before shipment.
5. Shipping
Use only the shipping method and label associated with the correct trade-in. A provided label does not transfer ownership or guarantee acceptance. TEST labels are not valid for real shipment and must never be used to mail hardware.
6. Packaging Responsibility
You are responsible for packaging hardware securely, following the displayed guidance, using accurate package measurements, and complying with carrier restrictions. Remove loose accessories unless included in the submission and protect equipment from impact, moisture, and electrostatic damage.
7. Loss or Damage in Transit
Report carrier loss or visible transit damage promptly. BuyMyTEK may require photographs, tracking records, packaging evidence, or carrier documentation. Responsibility and any carrier claim depend on the facts, the label used, packaging, and applicable carrier rules.
8. Unsafe, Prohibited, or Unexpected Items
Do not ship hazardous, recalled, swollen, leaking, contaminated, illegal, or unrelated items unless BuyMyTEK expressly approves them and the carrier permits shipment. BuyMyTEK may isolate, refuse, return, or lawfully dispose of unsafe or prohibited material.
9. Inspection Results
If the received hardware materially matches the submission, BuyMyTEK may approve the quoted amount. If it materially differs, BuyMyTEK may issue an adjusted offer, reject an item, or request more information. Minor cosmetic observations that remain within the selected condition should not by themselves change the offer.
10. Adjusted Offers
An adjusted offer will identify the revised amount and material reason when practical. You generally have seven calendar days from issuance to accept or decline. Silence is not acceptance; an unanswered adjusted or custom offer is treated as declined after the stated deadline. BuyMyTEK may make additional contact attempts and may extend or reissue an offer at its discretion, but an extension is effective only when communicated to you.
11. Declined Offers and Returns
If you decline an adjusted offer after materially misdescribing the item, you are responsible for return-shipping cost. If BuyMyTEK made the mistake or rejects an item you accurately represented, BuyMyTEK pays reasonable return shipping. Returns use the address and instructions confirmed for that trade-in.
12. Unclaimed Property
If you do not respond to required return or disposition communications, BuyMyTEK may send a documented final notice using your available contact methods. Hardware remaining unclaimed for 30 days after that final notice may be treated as abandoned to the extent permitted by applicable law. No automatic disposal, resale, recycling, or deletion process is created by this provision.
13. Payout Timing and Method
After final inspection approval or acceptance of the final adjusted offer, required seller verification, receipt of required payout instructions, and resolution of legitimate fraud, ownership, security, or compliance holds, BuyMyTEK will initiate the approved payout within 24 hours. Initiation does not mean that a seller's bank or payment provider will make funds available within 24 hours.
The site currently records a bank-transfer payout preference but does not collect online banking credentials or itself execute an automated payout. The final agreed amount and payment record control; a status label alone is not proof that funds were sent.
14. Transfer of Ownership
Ownership transfers to BuyMyTEK only when BuyMyTEK finally accepts the hardware and records the agreed payment, unless you separately authorize disposal. Until then, inspection custody does not by itself transfer title.
15. Cancellation
You may request cancellation before shipment or irreversible shipping activity. After shipment, inspection, acceptance, disposal, resale, or payment activity begins, cancellation may be unavailable. BuyMyTEK may cancel a transaction affected by error, fraud, illegality, safety risk, or unsupported hardware.
16. Personal Data on Hardware
Back up and remove personal data, sign out of accounts, disable activation or management locks, and reset devices before shipment. BuyMyTEK is not a data-backup service and cannot guarantee recovery or preservation of data left on submitted hardware.
17. Business and Bulk Submissions
Business IT and bulk submissions may require additional inventory review, logistics, authority, data-handling, and commercial terms. A Business IT intake is a request for review, not an accepted quote or pickup commitment.
18. Taxes and Reporting
You are responsible for determining and satisfying any tax or reporting obligations arising from a sale. BuyMyTEK may request information or provide records when required by law.
19. Fraud and Compliance Holds
BuyMyTEK may pause, investigate, reject, or report transactions involving suspected theft, identity misuse, sanctions, payment fraud, counterfeit hardware, account locks, unlawful conduct, or material misrepresentation.
20. Limitation of Liability
To the maximum extent permitted by law, BuyMyTEK is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. BuyMyTEK's aggregate liability relating to a trade-in will not exceed the greater of the final agreed trade-in amount or direct damages proven to result from BuyMyTEK's breach. Rights that cannot lawfully be limited remain unaffected.
21. Informal Dispute Resolution
Before arbitration or litigation, send a written notice to admin@buymytek.com with your name, trade-in number, facts, and requested resolution. The parties will attempt in good faith to resolve the matter for at least 30 days.
22. Small Claims
Either party may bring an individual claim in an eligible small-claims court if the claim remains within that court's jurisdiction and proceeds only on an individual basis.
23. Individual Binding Arbitration
Except for eligible individual small-claims matters and claims that cannot legally be arbitrated, disputes not resolved through the 30-day informal process will be decided by individual binding arbitration under the Federal Arbitration Act and administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration preserves remedies required by applicable law and may not proceed as a class, collective, consolidated, mass, or representative arbitration. Either party may seek urgent injunctive relief from a court with jurisdiction when necessary to protect rights or prevent immediate harm.
24. Jury Trial and Class-Action Waiver
To the extent permitted by law, each party waives a jury trial and agrees to bring claims only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, or representative action.
25. Arbitration Opt-Out
You may opt out of arbitration within 30 days after first accepting these Trade-In Terms by sending written notice to admin@buymytek.com. Include your full name, email address, a clear statement that you are opting out, the acceptance date, and the trade-in number when available. Opting out does not cancel the remaining terms or the trade-in.
26. Governing Law
Florida law governs these terms without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration provision and non-waivable consumer protections remain effective where applicable.
27. Electronic Records and Signatures
You consent to receive transaction records electronically and agree that checking the acceptance box and submitting the transaction constitutes an electronic signature. BuyMyTEK stores the accepted version, text, timestamp, and associated trade-in identifier.
28. Entire Agreement
These Trade-In Terms, the accepted quote or offer, the recorded agreement text, and any transaction-specific written terms form the agreement for the trade-in. Transaction-specific terms control only where they expressly conflict.
29. Changes
BuyMyTEK may revise these terms prospectively. The version accepted with a submitted trade-in remains associated with that trade-in and will not be replaced retroactively.
